Ministry of Labour Updates
OELs; Occupational Exposure Limits

In April 2004, the Ministry of Labour announced a new system to ensure that the limits of exposure to workplace chemicals are updated and improved regularly. Under the new system, occupational exposure limits (OELs) will be reviewed and updated on a regular basis, ensuring that the protection of Ontario workers is always based on the most current scientific and medical knowledge. OELs can currently be found in Ontario Regulation 833, the Control of Exposure to Biological or Chemical Agents. This regulation sets limits for over 700 workplace chemicals for three different categories: (1) TWAEV, the maximum allowable average airborne concentration for an 8-hour day or 40-hour workweek; (2) STEV, the maximum allowable average airborne concentration for a 15-minute period; and (3) CEV, the maximum allowable airborne concentration for a worker at any time (i.e. this limit cannot be exceeded). Employers that are subject to O.Reg.833 are required to ensure that workers’ exposures are as low as practicable and within the legislated limits. In addition to announcing a new updating system, MOL has amended the Regulation by introducing more protective limits for Manganese, Benzene, 1,3-Butadiene, and Carbon Monoxide.

Proposed Confined Space Regulation
In September 2001, MOL announced that a consolidated Confined Space Regulation would be created in order to standardize the safety requirements for working in a confined space regardless of whether workers are in an Industrial, Construction, Health Care or Mining setting. This proposed regulation would harmonize the existing requirements in the sector-specific regulations. According to recent discussions with the MOL, a draft regulation is currently being reviewed by key stakeholders and the Ministry intends to publish a final version soon.
